    Dismissed From Chapter 13 Due To Excess Income

    I have a dismissal from ch 13. Does anyone know how to get my credit back in good shape? I have made arrangements to pay off the creditors on my own. HELP!!!

    I'm confused - dismissed from a 13 for too much income? Would 100% payback have taken less than 3 years?

        correct me if i'm wrong.....but they just can't dismiss you without a hearing. Meaning if something is not right with the bankruptcy, your suppose to be notified along with your lawyer and then there's a hearing about dismissal. In other words, the trustee can make a motion for "dismissal" ....that is for a judge to decide! So something is wrong here with this.

          I am not sure what you really want us to say. Regarding your credit, you filed BK, that will be on your credit report for the next 7-10 years.

          All you can do is practice good credit habits from here on out.

          But I am curious as to why your case was dismissed for "too much income"

          If I had to speculate, you and the trustee disagreed about how much you should pay into your chapter 13 plan, and you never amended your plan...???

            that's what i don't understand because even a judge would tell you to amend the plan by a certain date or it will be dismissed. they just can't SEND you a letter saying it's dismissed!

            They DO give you an option!

              I'm thinking that Bigjet requested a voluntary dismissal because he/she thought they had more than enough disposable income ("too much income") to set up their own payment plan with the creditors and wouldn't be under the trustee's thumb any longer, Am I close, Bigjet?
