Filed and signed papers today...How I'm treating my HOA's

So I finally filed for a 13 today and I felt sick all day! But once I signed my life away I felt as though a weight had been lifted off my shoulders.

For those who had questions regarding the HOA's and how they would be handled my attorney advise me not to pay. I am surrendering 2 properties that have HOA's monthly and although I will be responsible until title changes, it will be up to the association to file a claim on the dues. We are adding the past association fees in the plan, but any future, they will have to file a claim. He advised that if they do not submit a claim during the 6 months, then the fees would be discharged.

Now that I've finally filed, I guess my fingers will be crossed until the meeting of creditors and hope the rest goes very smooth. My attorney seems to think so since everything else will be paid at 100%...but I guess we will see.

To everyone here...I am so glad that I have the support from all you guys.

    Congrats, Busbis!!

You've taken the first step toward securing a brighter financial future!!

Just remember to take it one day at a time. Don't forget to get that first payment in within 30 days.

And always remember,........... We're here to listen when you need an ear, help when we can, and root you on the whole way!!

I am not an attorney. My comments are based on personal experience and research. Always consult an attorney in your area to address concerns related to your particular situation.

Welcome to the 13 Club, Busbis. Today is the first day moving toward a better financial life with much less stress. So glad you are feeling better already!

As SF said, do be sure that your first payment is in the trustee's hands within 30 days. If your payment is going to come out of your paycheck automatically, sometimes that takes more than 30 days to start up. If that's the case for you, make the first payment yourself - don't wait for your payroll to straighten things out.

Keep asking questions, vent as necessary, and share the good times - that's why we're here!
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

      06/01/06 - Filed Ch 13
      06/28/06 - 341 Meeting
      07/18/06 - Confirmation Hearing - not confirmed, 3 objections
10/05/06 - Hearing to resolve 2 trustee objections
01/24/07 - Judge dismisses mortgage company objection
      09/27/07 - Confirmed at last!
06/10/11 - Trustee confirms all payments made
      08/10/11 - DISCHARGED !

      10/02/11 - CASE CLOSED
Countdown: 60 months paid, 0 months to go
