    Do I show the trustee????

    Hi, I was wondering when I file my taxes if I need to provide a copy of my tax return to my attorney and or Trustee. I asked my attorney but he hasn't got back to me yet. I heard that in Texas we get our refund back to us

    The best thing to do is ask if you do not have anything stated in your Plan paperwork from your attorney or the Trustee. In the past I understand it was a Trustee thing, differing from state to state, as to providing a tax return to the trustee each year. Some people did; some people didn't. I was told it became mandatory to provide tax returns during a Chapter 13 to a trustee with the new law that went into effect in 10/05 thereby doing away with the previous "state" thing. We filed in 2/02 and there was verbiage in our Plan Order stating we had to provide our returns each year within 5 days of filing our federal and state returns. We complied with every detail during our Plan so I have no idea what would have occurred had we not provided our returns. I understand it could be cause for dismissal. Always ask your attorney directly and you will always get the correct answer you need.

      We weren't sure about our tax refund situation until we read through the confirmed plan that was mailed to us by the trustee after our confirmation. It stated as a provision that all refunds were to be given to the trustee.
      Filed 07/07, $120k unsecured debt
      Plan: $400 (includes cram down) 60 months
      Brilliant attorney, decent trustee, awesome plan
