Thanks for sharing your expeirience today, Velo. Sorry you got such a self-important trustee - lucky your lawyer seems to know how to handle that well. Amazing that the trustee would go on your private property to snoop around...wow! Good that you were honest about the bikes (and also understand why your lawyer wasn't happy you hadn't told him about 'the collection').
Keep us posted on what goes on during the next 60 days. Sounds like it could be quite an experience. But in the end, no matter how prickly your trustee may be, since you qualify for Ch 7 and haven't hidden anything, you will be discharged. Hang in there!I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
06/01/06 - Filed Ch 13
06/28/06 - 341 Meeting
07/18/06 - Confirmation Hearing - not confirmed, 3 objections
10/05/06 - Hearing to resolve 2 trustee objections
01/24/07 - Judge dismisses mortgage company objection
09/27/07 - Confirmed at last!
06/10/11 - Trustee confirms all payments made
08/10/11 - DISCHARGED !
10/02/11 - CASE CLOSED
Countdown: 60 months paid, 0 months to go

Yeah, not disclosing the MTB's was willful ignorance and the assumption that it fell under some exemption. Attorney seemed to feel it was no big deal as I answered the question w/ complete honesty and if Trustee has issues he'll just make us get an appraisial value and seize. My biggest fear was some purchase, or component of our debt that would be objected to (of course we still have 60 days) and we'd be garnished.
Our attorney's cool... he was super pissed b/c the trustee grilled my wife about her home business, why she's still trying to make it profitable, etc... "Intentured survitude was abolished in law in the 1600's, so he can't tell you how you can and can't make your living. The BK law clearly states..." Thankfully we retained a good attorney!
