    Ch 13 to be reviewed 1/8 for closing

    Ok we made it to the very end, we filed our 13 in 03 (32K) and we are now close to being done. I just need to know what to expect as fas as closing time nears. Ch 13 Data center show our status as Z close to end. Thanks for any tips, suggestions you may have.

    According to what I have read the trustee lets the creditors know that you are about to close. They have 30 days to object and if no one does, then you are done. Then the trustee will send you the discharge paper.

      This forum is very helpful. I need the support.

      My trustee just told me about 13 datacenter website...even though I have been paying for nearly 4 years.

      My case status says ABOUT TO CLOSE. Does that mean about 30 days or so before it closes?

      But I don't understand how that is possible when the balance reflects still owe $5000 and paying $1000 per month.

      Originally I was to pay 48 months but my plan was modified a few months ago to pay back 100%.

      Any info on what ABOUT TO CLOSE means is appreciated.

            I was about to close last November, then the trustee upped my percentage to unsecured to 65 percent as I wasn't near my 36 month mark (august 08) so now I am 4 months away from the 65 percent. So am looking to April to be discharged.

              My unsecured was upped to 100perc at 38 months. My 48 months is Feb 2008. My original plan said 48 months 36k @ 700 a month. Secured paid off. In May 07 I started pay 1000

              You seem to know a bit abt this.....

              My acct says ABOUT TO CLOSE (could be 60 days)

              my BASE plan indicates OWE 2000

              My principal due indicates 5000......which means 5 more payments

              My 48 monthds is Feb 2008
              What is the the truth in YOUR opinion.

              My trustee and atty SUCK. Thanks ur opinion

                    well it is my opinion that only the trustee will decide when you are done. If your plan is scheduled to go 48 months, then the trustee will probably make it go that long. However, if you are 100 percent payback and you reach that 100 percent mark prior to the 48 months, then you should be discharged quicker. I am not at 100 percent payback and that is why the trustee upped it. Why did he up yours to 100 percent? after the 36 month mark?

                      Continue to make your payments until the last payment. Just prior to making that payment, contact your attorney that you are making the last payment. The Trustee will audit your Plan after your last payment and make the remaining distributions to the creditors. Each creditor has a certain amount of time to send signed paperwork back to the Trustee (I believe it is 30 days) after they receive that final distribution. Once those all all received by the Trustee and your Plan audited in full, you will be discharged. It takes about 90 days after your last payment is received.
