    completing chapter 13

    now i know why so many cannot complete chapter 13, just sent my 21st payment of a 36 month plan, barely scraped together the payment, so important when retaining attorney, make sure he/she is on your side, my attorney was paid $2000 for his serives, i am a senior citizen on a fixed ss income, i was put in chapter 13 by attorney with payment of $560 for 36 months, at that time he determined i had that much disposable income, 21 months later, rent has increased, medical insurance has increased and many other normal expenses have increased, he left no room for contingencies when filing, now need medical and dental service which approximate $4000. contacted my retained attorney, 3 messages to call me, to date, you guessed it no return calls so.......be very selective with retaining an attorney

    Next time you call, ask that they return your call by a certain date or you will have to assume that the attorney has "abandoned" you and your case, and that you will need to notify the state bar of their act of abandonment. See if that doesn't get a return call ASAP!

    You should be able to amend your case if your expenses have changed significantly, make sure you have records of everything. Good luck!

    Plan Modified July 8, 2009 from $1100/month to $400/month due to change in income, finally discharged in July of 2013!

      Your Plan can be modified. Working in a law office myself, I know the frustration that goes along with contacting an attorney and how legal wheels just continually grind slowly especially when it is your own matter. Anyway, call the law office again, ask for your attorney's paralegal or legal assistant if the attorney is not available. Explain your situation to the paralegal or assistant and that you have called 3 times with no answer. You will get a return call. Best of luck to you.
