    Need your advise

    I set-up two consultations with attorneys for this month. The first attorney who I talked to about 3 months ago via the telephone gave me some really good advise and really saved my hide. And he has been out sick with pneomonia since before Christmas. Not sure if he will be up to speed with the new changes that came into effect Jan 2008. This firm specializes in bankrupcy and the owner of the firm is a chapter 7 trustee.

    The second attorney I called works 1 mile from our house but I get the oppinion that he is a solo operator. He asked questions that I answered yes or no too then I had the opportunity to ask him questions. This is when I got that feeling that he was not listening to what I said. I asked specific questions and he gave short answers to. Then I asked him what documents I needed to bring and after listening to him I told him that I had everthing he needed and when he would be available, and you guess it, he said you need to prepare the documents and bring them with me....Obviously he was not listening when I said I had every done. He even said this 1 more time.
    I am not sure that I even want to waste time with this individual. I also asked him how many of his cases get dismissed due to clerical errors and he was quick to point out that the cases get dismissed due to the debtors inability to make the plan payments. He is right, but ultimately it is his job to make the plan so that the debtor should be able to make the plan payments.

    Am I just paranoid....and expecting too much.

    If you are not happy with an attorney, you don't have to hire him/her to represent you. Call your state Bar Association and get names of the best attorneys in your area that handle bankruptcies. It makes all the difference in the world, believe me.

      Go with the first attorney. Even if he is still out ill, the firm specializes in BK. Also, with the owner of the firm being a BK 7 trustee, he/she will have relationships most likely with the other trustees, and it will make it easier for your plan to be done right the first time, and most likely a bit easier to get approval. Sine the owner is a BK trustee, specializes in BK at his firm, they have more to lose if they do it wrong, especially from a reputation stand point. Follow your gut, and go with the first firm you spoke with. The second attorney sounds like a novice, and I sure don't want to be part of some ones learning curve. Just like picking a surgeon. You want the one who specializes in that specific surgery, has done many, many of the same operation sucessfully over time. Not the doc who is fresh out of med school and is still developing their skills.

        Thank you so much for the advice. Yes, I believe I will go with the lawyer who specializes in Bankrupcy. He has always been very helpful via the telephone.
