    Getting a Credit Card

    I would hesitate to get and use one, since misusing credit got me in trouble in the first place, but as someone in business who sometimes does not get enough funds in advance to cover the costs to do a job, a credit card would come in handy. And new credit is allowable without permission from the trustee if used for business purposes.

    Are there any possibilities of getting a credit card while in chapter 13?

    Try Orchard Bank through HSBC. They don't have high limits, but I have applied for 2 since filing for BK 13 and have been approved. I use them only for business expenses since my corporate card was cancelled after I filed, and I make sure not to carry a balance. I believe you can have 2 Orchard cards at the most. I applied for them about 6 months apart. We even IIB'd HSBC, so I was surprised, but delighted to get them.

      First, check with your attorney to see if you can open one. There should be no problem if the limit is kept low (i.e., under $500). In the past (don't know if it may have changed with the new law), many trustees did not have an issue with obtaining a credit card with a low limit. You are not to take on any new credit during your Chapter 13 so begore you apply, make sure it is OK. I also suggest Orchard Bank as they will probably offer you a card with a $300 limit to start - you will have a yearly fee of maybe $35 or $59 or in that range. Many people have troubles with Orchard Bank but we have not and I have had their card for 1 1/2 years. Initially $300 credit and increased last summer to $700., 14.99% Yearly fee of $39. It gets paid in full when used. We also have a Washington Mutual Visa that we obtained after discharge. 11.99% with an initial $3,500 limit. They increased it in November (of course, right before Christmas) to $8,500. They deluge us with credit offers and cash advance checks. We don't go that route and use it for car repairs and other repairs that need to be done in the house, etc. and pay it off in full.

        under new law, my lawyer says absolutely no new credit card debt. however here we go again, where in the book does it tell you you can't apply for a credit card.....no where!

        secured credit cards yes! visa check cards/debit cards YES! lines of credit, unsecured credit cards.......nope!

        now my confirmed plan says i can buy or acquire anything under $5k

          We Wre Told We Could Have A Card But Not To Carry A Balance, Whatever You Charge Had To Be Paid Each Maonth, We Opted To Open A Second Account With A Check Card We Keep $500 In To Use Lke A Secured Card. Same Thing What We Use We Repay Each Month Plus No Intrest Or Fees
