    Tax Rebate question again!!

I am hoping that we get to keep our tax rebate. We get to keep our refunds, so I am hoping that we get to keep the rebate also. Question, what happens with the rebate if only 1 person has filed bankrupcty. Husband filed 13, I did not, but we both pay taxes. I am just hoping that we get to keep it, also do you think that we could use the rebate to pay off 13? The rebates should hit around the time that I will only have 3 months left on 13. Just a thought.

Your husband will need to ask his attorney when his rebate check comes in. A couple will get $1200. His share of the rebate will be only $600. Since at that time you will only have three months left to pay, he can just apply that amount to his payment if he wishes (if he can keep it, his attorney will advise him). Your share of $600 should not count. If you have any children, you will receive $300 for each of them but if you file jointly and claim them as dependents, your husband should discuss that portion of the rebate with his attorney.

Keep in mind that the wording is UP TO $1200. Not everyone will receive that amount......
      Filed 07/07, $120k unsecured debt
Plan: $400 (includes cram down) 60 months
Brilliant attorney, decent trustee, awesome plan
