Used Car

Hey everyone,

I filed ch 13 in august of last year and about 2 months prior to that I leased (36 month lease) a new car and I assumed the lease and paying outside the plan. I realized that I probably should have just bought something to get me through the 60 months. I have an opportunity where I can get rid of that lease and my parents will get me a used car in their name and I will just pay them monthly. As long as I don't pay anymore than I am paying now monthly, would this be a big problem??

Technically, you must get approval from your trustee to aquire ANY new debt.

However, sounds like you got an under the table deal going with your parents. If you are certain they will NEVER go after you in court because you miss a payment to them (loss of job, etc), then you can probably get away with it. However, if they do for some reason report something, your case could be dismissed.

Check with your lawyer, Phil. He/she knows the details of your case and what your trustee may or may not balk at. Don't do anything until you run this by your lawyer and get sound legal advice. You could find yourself in a heap of trouble otherwise.
