    Question about mortgage and escrow account

    We filed Ch. 13 in the summer and had to roll some house payments (with insurance and taxes escrowed in) into the bk. Mortgage company paid the taxes and insurance like normal, but of course, now the escrow account is low. My question is, when the mortgage company re-assesses the escrow account in April, is it going to make our house payment go up? I don't think it should b/c we are paying it back through our plan. And if it makes it go up, then we just can't afford it.

    Our escrow went up (along w/our interest), our payment went up & our trustee payment went up. You will have to file an amended plan to include the increase in your payments to escrow. Do you have room in your plan to do this?

      We don't have our house payment included in the trustee payment and we don't have an ARM.

        Discuss this with your lawyer. One thing I can say for sure is that your mortgage company will not make your escrow payment if there are insufficient funds in your escrow account to do so.

          You will have to pay your escrow, so if you can't afford it, you need to have your lawyer amend your chapter 13 plan payments so you can.
