? about buying a house at end 13

Hi we are done paying our 36 month repayment. 13 network says closed as of 2/10/08 No discharge papers. Still shows balance on hand & creditors not paid yet. Can we try to get a mortgage loan with out the trustee approval if it says closed. our mortgage broker says she can get us a rate of 5.87% the house we like just dropped $10,000.00 we don't want it grabbed up by someone else.
We plan to call our lawyer Monday but it will take ages for him to get back to us. Our realtor thinks we should just call the trustee & ask what the hold up is. (LOL she's never declared bankruptcy)Any one ever in this situation or have any insight . We would much appreciate it.

No bank or lender will touch you without permission from the Trustee since your BK is not yet discharged. You may not receive your discharge papers for may another 90 days yet while your Plan is audited and creditors paid in full. That is what the hold up right now is about - it's not really a hold up but procedure. Contact your attorney and explain the situation. You may be able to start looking into a mortgage or house right now but not be able to sign anything at the moment.
