    This is a reporting error, right?

    Wells Fargo Home Mortgage is reporting my Pay Status as Foreclosure. But they didn't file a Notice of Default until two months after I filed BK. I thought they could not report that foreclosure after I'd filed. I thought that they could only report what they had been reporting before I filed....90 days late, 150 days late, whatever. I've disputed this with them and they've marked my CR with customer disputes. They are only reporting this way with Experian.

    This is just like a CC company can't say the debt was charged off if it wasn't in charge off status before filing, right?

    Or am I wrong and its discharge date, not filing date?

    After you filed, have you paid any mortgage payments after the actual due date? Has Wells Fargo filed a formal request with the court to undo the automatic stay and start foreclosure proceedings?

      As far as I know, no payments have been made to Wells. I don't live in the house, my ex-husband does. He hadn't made a payment since Sept '07. This was a joint loan with him, but I'm the only one who filed BK. They filed the paperwork for relief from the stay, and I agreed to it. They filed the notice of default in late February. I shouldn't have done that? I mean agreeing to the lift of the stay? I figured if they took me to court I didn't have any objections to it.

        Since you didn't want the house, what you did was the right path to follow.

        Surrendering the home to foreclosure during bankruptcy does allow your lender to state the home was foreclosed on your credit report because that's truthful. Be sure the amount showing as owed is $0.

        When homes are foreclosed during bankruptcy, most creditors will see the two bad financial events as one. It's better for your future credit recovery overall.
