    Ch 7 and house

    I am thinking about converting to a ch 7. I filed 13 to save my home but it will be best just to let it go. So if we convert to 7 how long until we have to get out of the house? Is it after the 7 discharge?

    Are you behind in your mortgage payments and if so, how many? The foreclosure process averages 7 - 9 months since there are tons of foreclosures going on. However, that is average and doesn't mean a thing. Foreclosures are generally started after 2 or 3 payments are missed and during that time you can stay in the house for several months. Discuss the matter with your attorney because it will take time to convert to a Chapter 7.

      We were like 4 months behind when we got the letter for the sale date. That is when we filed 13. I was thinking if we converted to 7
      then the foreclosure would start where it left off. We have not paid the mortgage for this month yet.

        So they will have to restart the whole foreclosure process from scratch?

          No, they file for relief from stay and once granted, they'll proceed. How long it takes depends on the law in your state.
