    Could This Be A Scam or What?

    Today a friend from California called me named (deleted by moderator - call him Person 1) and stated that he was having some issues with his loan. He said a loan service in which a staff member named (deleted by moderator - call him Person 2) filed a suit against him claiming that he had defaulted on the loan. Person 2 also enjoined his action with numerous subsequent claims stating that it was entitled to seize some property of Person 1's. Person 1 stated that: "he had paid his payments on time every month and has met all requirements, and further stated that he did not put up any collateral regarding land because the land in question was in litigation and had a freeze on it, and the Clerk of Court held on to the title and he was not even allowed to occupy the land til disposition. Person 2 also filed charges on behalf the county in which one of the claims stated that he is collecting on the fees for the Sheriff delivering process, regarding returning the title of the property. Person 1 stated that: "the plaintiff took out the suit and had to quash claims and it has to pay the cost, for he didn't file action and the county seized the title to land in question and it had a duty to return and he owed nothing. Person 2's subsequent claim was on behalf the county attempting to collect owed taxes. Person 1 stated that: "he and the county settled the issue and made an installment plan regarding the fact that he was not given notice for one of the county's claim until 10 years after the fact and the county had to drop that claim because of limitations period, and the other claim was 8 to 9 years late, but he's gonna pay installments on that claim". Person 1 states that: "plaintiff has no standing to sue on behalf the county, and has documentation regarding his standing on the payments. He further stated that he has heard of issues to were some folk who have gotten loans, and the lender was using the collateral when payments were being made, such as other property, and second homes, and renting the out and the owner never knew. Person 1 stated that the loan was for improvements on his home and additions. He said by the time he got the title back he had already paid half the loan back withing the first quater. He filed a counter claim for dismissal and for sanctions against the plaintiff and his attorney (name deleted by moderator) for using the judicial process for malicious means regarding the numerous claims the lender keeps filing against him and for the improvedent use of Judicial economy. He is also seeking damaging for emotional distress for the lender charging late fees when payments were not late, and for garnishing wages from his debit account. Also for the worry that he would loose his property that made his blood pressure rise and suffered pain in the stomach from the worry.
    Tell me community, is this a scam these lenders are running or what?

    Not to be offensive but you have phrased everything in one paragraph with superflous information like names and to the reader it is more or less confusing. break it down simply minus all unnecessary info and you may get a good response. honestly, most people won't read it the way it is written. Just a simple explanation is all that is needed.

      What are you actually worried about? Boil this complex run-on story down to something digestible please - then maybe we can help you. (And please in the future, no names in posts - thanks!)

        Please edit your super paragraph.

        Basically speaking though your friend needs a lawyer. If he doesn't have one he needs one. Only a lawyer can help him out. It seems suspicious on the surface but there are a lot of bottom feeders in the court systems. Your friend needs competent legal advice.

        September 4th, 2007: Discharged and Closed.

              I believe the correct answer is pickles and ketchup, hold the onions.

              I actually separated out this Troll's mega paragraph, gave the persons real names (Homer & Jethro), and it is still just nonsense.

              However if Homer declares Chapter 12 bankruptcy your problems will be over.
