    Creditors Calling at 5:30am

    A creditor called my mil's home at 5:30am this morning. Unbelievable. Thank god she get's up early and wasn't mad.

    This is going on my 4th month overdue. I have no way of knowing if it was the oc or not.

    I've been avoiding the calls at work but maybe I should start answering.....and have a script ready that won't embaress me because other people will hear if they are at their desk.

    I guess basically I'd say - I live at such and such address and you can send all correspondence to me there and not to call me at work or contact any of my relatives. I doubt it will work though because I answered in the beginning and asked not to be called at work and they just kept calling - so I stopped answering.

    I believe there is a law regarding what hours they are allowed to call between. Otherwise it is harassment. They also cant call friends and family.

      This creditor violated the FDCA big time. They are not allowed to call anyone before 8 am or after 9 pm at the call receipient's local time. See http://www.fair-debt-collection.com/fair-debt-act.html - the Collection Calls and Communication Rules section.

      Don't mess with a script. Send the creditors that are harrassing you this way a certified return receipt letter stating from here on out they are only allowed to contact you by mail. Then put a message on your answering machine and cell phone that clearly identifies you. Legally collectors are only allowed to contact others if they can't find you. Many of our members have gotten a significant decrease in their calls by doing this.

      If you do still do get a call at work, simply state that you are not allowed to take personal calls at work, please do not call you there again, and hang up.

        The FDCPA does not apply to original creditors, unless you live in a state that requires such rules for creditors as the FDCPA requires of collection agencies. Still, there are some states that have laws protecting you from telephone harrassment.
