    can i file chapter 7

    i have no tax returns because of a disability i havent worked in 3 years i have 20000 in cc debt i used wifes income as household income we recently had to move because our other place was sold out from under us so we now have 400 mh payment to make things worse my ssi case is taking forever been waiting on hearing 14 months

      i wonder if it would mess up my disability case also can i file chapter 7

        SSI shouldn't be affected by a BK. However, since you have no income and presumably nothing (assets) that the creditors can try to go after, why file at all? I'd wait until there was a real need, not over 20K of credit card debt that they can't collect on anyhow, even with a judgement. Just my opinion.

            You must file a 2007 federal tax return if your gross income during 2007 was at least $8,750, or if married and filing jointly $17,500. Each year the level can change, so you'll have to google for 2005 and 2006 minimum income levels.

            Assuming you fell below the minimum income levels all three years, you are not required to file federal income tax returns (although if you did, you could find that you are likely to get a little money back).

            The court can't ask for what you legally did not have to provide to the government if you file bankruptcy. However, you may be asked to provide proof of your disability and you almost certainly will be asked how you survived financially for three years with no income.

            You should set up a few free or low cost initial consultations with several bankruptcy lawyers in your area to be certain that you are ok to not file returns and still file bankruptcy.

            The worst case scenario is you may have to file now for those three years with big fat zeroes in all the columns

              thanks my common law wife has been paying the bills aiso my two daughters were working but they have moved out our hhi was 45 to 60000 now its around 20000 and we have 2 teenage adopted sons
