More questions about kids income????

The kids income concerns me because it may be the deciding factor for me being able to file chapter 7. Here are some questions I have.
Does anyone know spefically where kids income is taken out later in the means test?
Has the trustee ever asked anyone if thier kids work?

My kids work but contribute nothing to the house hold. They buy thier own gas but that is about it. The rest is spent on their personal expenses.

Our lawyer said not to include their income when I called him earlier today. He said that they are minors and not contributing to household finances. If they were borders...different story.

Our attorney did list their checking account numbers on our BK forms with a note that said account is held with minor child for the benefit of minor child.

Basically you should check with your attorney and follow the advise he gives you. He is going to know the way your trustee prefers the form filled out.

These are some of the problems with the poorly drafted means test form and recent changes in BK law.

Thanks MomIcantFindmy. The previous thread shed alot of doubt about removing kids income later in the means test. It cannot be taken out on line 17. Instructions are clear about how line 17 should be completed. It seems all the odds are against me and I may have to file chapter 13 or drown in debt.

lrprn - That is the VERY first time I have heard WOODY. Go hang out in chapter 13 where you belong. I may have to be there myself someday. Hating life, making payments, etc....0 payments, 60 to go.
