    OMG! Late Final Filing Fee Pymt = Court Hearing on 7/7

    Geez....I think I royally screwed up and the worst part is, is that I'm less than a week away from being discharged.

    Filed Chap 7 on 3/17/08
    Included in filing was request to pay filing fee in installments.
    Last Day for Objections is 6/13/08

    Here's my problem.... because everything has been going soooo smoothly, I haven't checked Pacer in quite some time and I completely forgot that I had one final filing fee installment payment due and owing. On Friday (6/6) I purchased a money order and mailed same with a letter to the BK Court. It will arrive tomorrow, 6/7. I checked my Pacer Account today and saw that a Notice of Hearing has been scheduled for 7/7 for failure to pay final installment payment ($99.50). The Notice also states that if payment is not immediately received, my case will be dismissed.

    I read and reread that filing fees must be paid no later than 120 days after filing the petition, so I'm within that 120 days time frame.

    I plan on calling the Clerk's office tomorrow afternoon, hopefully I will see Pacer reflect my final installment payment first so the Clerk's office doesn't think I'm trying to blow smoke up their butts.

    Has this happened to anyone else? Will they dismiss the hearing scheduled for 7/7 after they update my account to show the final payment has been received or will they still have the hearing? Will my discharge be delayed?

    Since you are paying in installments and the installment was not received by it's due date, that's what triggered the problem. Once you call them tomorrow, you should not have any issues especially since they will receive the payment tomorrow. You should be fine with an explanation and immediate payment. But it goes to show anyone reading this that you can't fool around with the system - they go by the book and don't fool around.

      I am so glad I paid in full. I would've been so mad if they dismissed me because of me forgetting something.

      I hope the OP is able to get back on track and things go smoothly.

        So long as you get the payment to them in the 120 day limit I think you'll be fine
        May 31st, 2007: Petition Filed by my lawyer
        July 2nd, 2007: 341 Meeting Held
        September 4th, 2007: Discharged and Closed.
