    Can't file yet. What should I do?

    So I was planning on paying the rest of my attorney fees, roughly $1800, by the end of July and then filing my CH7. However, it looks like I won't have enough money to accomplish that plan.

    I stopped paying my bills that I plan to include in the BK about a month ago. Let's say I have enough money to file at the end of August. That's about 4 months of not paying my bills. Will this cause any problems other than lots and lots of phone calls?

          So stop talking to them. No reason to talk to evil people. You'll be getting threatening letters long before they get around to sueing you, and that's only after they send you the polite "how about sending in a payment" letters.

            Make sure your telephone is one that comes with Caller ID and Voicemail (not the service, a handset with those features). That way you can screen your calls. Most coolection agencies' numbers come in as 00000s.

              Just a note,

              I'm getting tons of calls from creditors, and every now and then I answer them; it seems to slow down the calls.

              Maybe it's me, but I have not had any problems dealing with these folks. Once I made up my mind that I was filing for bk, maybe I got less sensitive to these folks ....

              bottom line: yes, i get a lot of calls (I stopped paying in april), but really it has not bothered me. I ignore them and turn off the phone for periods of time ....

                It won't make any difference. It generally takes 6 months to a year for them to take legal action and that is a slow process.
                May 31st, 2007: Petition Filed by my lawyer
                July 2nd, 2007: 341 Meeting Held
                September 4th, 2007: Discharged and Closed.

                  jrscott is right. I quit paying my creditors. Went through a debt resolution company to try to negotiate lower payoffs and payed some off but it took a year and a half. Meanwhile I hadn't paid any of the other creditors and it about then that one finally started legal proceedings against me.

                  So you got plenty of time. Don't talk to them. Save your money for your lawyer and then file. Creditors need to have you served with a notice (SUMMONS) before they take you to court so it won't happen without you knowing and it will be a long time before they go that route.

                    I understand your concern but you can do one of two things; ignore the calls (I highly recommend caller ID; you can usually recognize creditors, telemarketers or collection agencies immediately) or answer them and advise the caller that you will shortly be filing Bankruptcy and they will be included.

                      It takes 5 minutes to change your phone number.

                      I must ask- why do you all put yourself through those phone calls? Can someone explain?
