    Now Am I Confused or Not?

    When you get letter from USBK Court that references your C13 and it states,

    "CERTIFICATE OF COMPLETION" and the last two sentences go on to say that the Trustee will file a final report and account when all checks issued in this case, have cleared the payor bank.
    The trustee recommends that the debtor be granted a discharge pursuant to xx.usc xxx.

    Does THIS mean IT is over AND FINALLY DONE and I am out from under the BIG SQEEZE"?

    FREE TO GO?

    I am kinda in shock that all this happened SO quickly! I figured that after the last payment, there would another period of time before I would be seeing

    "CERIFICATE OF COMPLETION"

    Is this a dream or what?

    Ya see what I am getting at, (besides being confused) is this................for everyone just starting out in a 13 be it 36 or 60 months, time goes by faster than you think.

    Thanks again to everyone for their help and kind words. This web site has been a place of comfort and will continue to help all those folks just beginning up the winding BK road.

    A "Periodic Report" covering from 1/08 to 6/23/08 was also in the envelope.
    Would this be what the Trustee calls a "final report"? >answers own question>>payors checks wouldn't of cleared that quickly>>so NO, right?

    are you in Michigan? My completion is scheduled for Nov 3. so I have 4 more payments to send in. Nothing is beng paid, except the additional fees to my attorney. I have the telephone number of the staff member handling my case and she told me to call her on Nov 3 and she would issue the order to stop sending in payments that day. Then I noticed on my student loan website it states "account in suspension, next payment due, 12/08" I hope mine will end that fast as well.

      You have received the usual letter sent by the Trustee after your last payment is received advising you how your BK will be closed out. It is not yet closed. An audit has to be done and all final payments sent to all creditors and all creditors notified they have been paid in full. Those creditors have to sign documentation and return it to the Trustee (this should all have been explained in the letter - it was in ours). When the Trustee receives all that paperwork and all the stars and planets align for your matter, you will receive your discharge papers in the mail showing the date of discharge.

      I am glad your Chapter 13 went by quickly for you. Ours was for 60 months and we bought out early as soon as we found out we were able and would have struggled terribly due to major items we would have had to put off past that five year mark (roof replacement and other major household items, vehicles that would have had extremely high mileage and at the end of the Plan be 8 years old, etc.). In fact, the roof would not have lasted and we would have had a major, major situation on our hands had we not been able to refinance and buy out.

      Best of luck to you at the completion of your Plan. It may not be sunshine and roses for the next few years but there is light at the end of the Chapter 13 tunnel!

          On the NDC, the information posted by my Trustees office,
          states "Date Case Closed 6/23/08" Case Status---
          "Completed".

          The official form has the judges name at the right upper corner and looks just like a summons/court document one would receive for a court case.

          "IN THE UNITED STATES BANKRUPTCY COURT FOR THE WESTERN DISTRICT OF __________ (names state & city) STATE AT CITY"

          In Re: My name IN CHAPTER 13
          PROCEEDING NO.XX-XXXXX
          The last sentence, the Trustee recommends that the debtor be granted a discharge....................Dated: June 23, 2008

          On the Periodic Report, "Please retain for your records--Copies are NOT available" is stamped in red ink.
          None of the other reports, which came every six months, had that stamped on them.

          Please don't take this the wrong way as we all know, each Trustee does things differently. Like your letter explained the procedure, mine does not.

          I know the creditors have to sign off however in bold print enclosed in a box and underlined is this:
          "Your case is closed. We are sending you this final audit of receipts and disbursements".
          ( a copy has been sent to your attorney )

          I too, experienced a couple of major situations, like having AAA surgery as the main one. Paying off what insurance didn't cover, was VERY hard.
          Yes it was a VERY difficult time due to the death of my husband. I lost everything we had worked 30 years to accomplish up to and including our home to foreclosure.
          I've had to move twice and that was costly.

          I could go on but why?
          Life has it's "peaks and valleys" and it IS a hard, long climb out the C13 valley.

          Thanks for your reply and I hope I didn't offend you as you have a wealth of knowledge that I am sure extends beyond the BK system.
