    Help! What should my spouse do?

    My spouse still has great credit, but she will probably be dragged into the ch 7 bk with me because some of the creditors are suing us both.

    While my wife still has good credit, is there anything I should do as far as preperation for the bk? I'm not planning to file for 6-12 months. Her credit is excellent (750) and will remain so until the bk, where she will have to be brought into the bk.

    Should she get some credit cards in her name? Is there anything that she should do while she still has great credit to help us prepare for life after bk?

    You are both being sued now by creditors and you yourself want to wait 6 to 12 months to file? If your wife is being sued, along with you, right now, her credit is not excellent so obtaining more credit in that scenerio probably won't happen or is not a good thing to do at this time.

      Frodo, there are a lot of threads on this. You can do a search and find a lot of them or simply scroll back to previous discussions.

      It's probably time for you to get to a lawyer to get some detailed legal guidance. Good luck.

        Okay calm down.

        Is this a threat of a suit? They'll do that for a while.

        Have you both actually been served? If that's the case you probably don't have 6-12 months. It is probably time to see some bk attorneys and get things in motion. Most will allow a free consult. Then for a small retainer you can get them on board, many will then take calls from creditors and handle that nipping in the bud most lawsuits etc as they are pointless.

        As far as more credit, since both of you would be filing it makes no sense to take out new cards in her name only, as they would still have to be included in the bk.
        May 31st, 2007: Petition Filed by my lawyer
        July 2nd, 2007: 341 Meeting Held
        September 4th, 2007: Discharged and Closed.
