    Does trustee question both husband and wife

    At the 341 hearings does the trustee usually ask questions of both the husband and wife, or does he/she just pick one or the other? Trying to be prepared and prepare DH. Thanks.

    If you are filing jointly, he could question one or the other as to anything (i.e., their own specific income, etc.).

      If its a joint filing, you both must go to the 341 and you will both go up to the trustees table at the same time.

      Some questions you both will be required to answer, i.e. "did you read the petition before signing?" etc. But for specific questions, generally, which ever spouse is more knowledgeable can answer.

        At our they questioned both of us simutaneously, we both said yes or no into the recorded at the same time.

          In my 341 all questions I heard were directed at both husband and wife and the trustee looked back and forth between them to see who would answer. 99.9% were ones where he expected both to answer yes or no. "did you both read the bk papers? did you both file your last 4 years taxes?" etc.
          May 2008: Filed Chapter 13
          Jan 2010: Plan Amended and Confirmed! finally plan funds = total funds due!
          Jul 2013: 5 years done! Trustee set to discharge! Woo hoooo!

            Thanks guys, wasn't sure how it worked. By the way, did anyone else have trouble getting into the forum from yesterday afternoon until around just now? I couldn't get into it and was about to have a panic attack!

              I was going through withdraws!!!!

              May 21, 2009 Retained 2nd Attorney
              May 28th - Filed for Ch 7 (FINALLY!)
              9/11/09 - DISCHARGED!!!!

                yes the forum was down. Our trustee ask us both questions however with my husband's stroke, he wasn't too quick to answer so the trustee just started to ask me. LOL
