    BK Trustees, Are They Ruthless

    My wife and I are in the first stages of filing for bk7. We will fall under the means test pretty easily, but we are concerned about one of her accounts. She runs an extra cirricular program and she established a business checking account that parents write their checks to. Right now there is around $5,000 in there for uniforms and such, but it will be almost ALL gone in a few weeks, before the filing. Should this account even be disclosed during the bk as it does not pertain to our income at all? We are afraid that if we don't, they might dismiss our bk7. My wife just emailed the atty we think we are going with, so we will see what her response is. I am just afraid that they will see this and just be complete scumbacgs about it.

    Generally the advice here is to discuss this with your attorney. Are you filing pro se?

      No, my wife emailed the atty today to see to ask her what could happen, if anything. She is specialized in BKs so she should have a good idea...hopefully

        When it comes to ANYTHING financial in a BK, it is always best to be honest about it and ask your attorney...because whatever is hidden or not discussed almost always comes out in the end and bites hard. There are postings on here all the time about people not mentioning something prior to filing and then all hell breaks loose when it is discovered or brought to the attorney's attention after the fact.

          Thanks guys. Hopefully we will get a response from the atty in the morning. Gotta get this thing done ASAP.

            my trustee was nice, but i dont know how nice he would be if he thought i was scr3wing with him.
