    House payments re-aff question.

    hi there!

    we met another attorney today and was surprised to know that we'll have to re-affirm our house payments in our payment plan. And it's the law / required by trustee in the area I live (She calls is the 'east district law').

    Is that true? Isn't it a nationwide law/policy to make a selection either to re-affirm or not re-aff house payments?

    My budget plan went up from $275 to $4500. And don't want to commit myself to this hefty payment. Though I don't mind it if it is outside the payment plan.

    pls share some knowledge.
    12/31/08: Filed for ch 13. (FICO: 605 as of 1/5/09, 648 as of July 2010). 02/11/09: 341 mtg. Plan confirmed for $200 per month for 36 months... (20 down 16 left)

    Hi there,
    Wow, that's a hefty payment, how much is your mortgage outside the plan? I don't have any advice (I'm sure someone with more knowlege will come along soon), but I *thought* that a mortgage and/or a car(s) could be paid outside the plan if you kept the payments current. I know the trustee gets a % of the payment, so maybe that's why they *want* it inside the plan.

    May 21, 2009 Retained 2nd Attorney
    May 28th - Filed for Ch 7 (FINALLY!)
    9/11/09 - DISCHARGED!!!!
