We've finally filed for Chpt 13...and are waiting for a "confirmation". The original amount our attorney had us paying back is $1400.00....they had erred on our income. We are retirees and our income IS taxed. They hadn't considered the taxes. The payment is now $800.00. Now the problem. When we originally talked to one of the attornies in the group, we told him my DHs 401K would be down to 0 next spring but that then he would be getting SS. The SS is about $800.00 less than the 401K. He said we need to come back to him before that occurs and they'll re-evaluate. Now, the other attorney we've been assigned says we'll have to pay the FULL $800. for the full 60 months....that'll leave us with $700.00 for food, drs, meds, & gas!!!!!! Anyone else had this happen????? Do I have to try to get a job??? I'm handicapped and what I'd get MIGHT pay only a few dollars a month!!! I'm SOOOO upset at the different stories we get every time we talk to them!

First, your Chapter 13 cannot be based on an event (change of income) that has not yet occurred. When this event actually occurs and can be supported by paperwork as to the change of circumstances/income, then you can look into having your Plan modified or whatever else can be done at that time._________________________________________
