    So close to the end - with questions!

    I filed for chapter 13 in Sept 2005, and I made my first payment November 20, 2005. Because there was a huge rush to file before the law changed, my case wasn't confirmed until 12/22/2006. There were no problems, no disputes, no nada. The proposed length of plan is the standard 36 months.

    My 13network shows 4 more payments - which is fine - even though TECHNICALLY, it's 3. The base balance, divided by 3 is the amount of my payments, so I think that is fine.

    My problem is is this...

    My Case status shows: Active (12/22/2009)
    and there is a Closing Order Date of Tuesday, December 22, 2009

    Will I have to continue to make payments until 2009?????

    When I filed, I had the payments auto drafted out of my bank account, so they'd never be late, or missing, or anything. I know that I will probably have to make a payment or two after the actual final date, but PLEASE tell me that I don't have to make payments for another year just because it took them forever to get it confirmed.

    My lawyers are losers - and they have even "switched" since I filed. They have changed paralegals 100 times, and the partners are no more. The nice people that I felt comfortable filing with are gone so I've given up on them.

    Any help and/or advice that you can give me is appreciated!!

    Mine said something like that also, a date way in the future, well past our projected closing date. I don't know why they do that, but I wouldn't worry. Sounds like you have almost made it. Congratulations.

    And if you are really worried, call your trustee. I know some on here say never bother the trustee, but I called mine several times and the office staff were always nice, and helpful.

      arkienurse is correct - don't worry about it. What I would do when you approach your last payment and/or send it in is notify your attorney that you have done so (via phone and regular mail); and since you state you are experiencing issues with your attorney and/or his office, I would copy the trustee on that letter listing your case number, etc. Advise the payments are being taken out of your account via autodraft and you would like to know when you can stop that autodraft feature or if it is in place by the Trustee, when he will stop it. What normally occurs is when you make your last payment, the Trustee will contact you by mail with information as to what will occur now prior to discharge and the timeframe in which you can expect your discharge. An audit will be done of your Plan during that time. The normal time frame for getting a discharge after receiving that letter from the Trustee is about two months, give or take.

        you need to find out if your plan starting counting from date of confirmation which is what is looks like from the information you provided. You can call the trustee's office and ask if that is the case.

        I was disappointed to discover that my 36 months didn't even start counting until confirmation date and my information also states my closing date as Nov 3, 2008 (39 months after filing for a 36 month plan )

          Dear so close:

          We did exactly what the 1st replier said to do. When we were one payment away from ending our payments, we contacted our attorney and asked them to petition the court to stop the wage deduction. The order was processed within a week and we ended up with only one payment over because it took forever for my company to process the stop order. The Trustee's office refunded that payment within a week. By the way, we had our discharge within two weeks of the last payment. Things can happen fast. Good luck to you.
