First off I wanted to thank all of you who have taken the time to post your experiences and knowledge about your situations prior to, during, and after Bankruptcy. After several unsuccessful attempts to "catch up" mortgage payments I received a NOD, I felt as though I had a huge Scarlett letter on my forehead (only instead of it being the letter "A" it was an "L") Everytime I walked out of my house and saw a neighbor, it was like they knew my "secret" and that I would be the cause of their plummeting home value. I don't remember the last time I slept through the night worrying about how to catch up with all of my bills and by the time I did fall asleep, I was serenaded by the host of bill collectors with their serial calls, minutes before their allowed am time.
I began surfing the internet to find mortgage help when I read bout Bankruptcy and Chapter 13. I was fortunate to find this site and the information has been priceless. I interviewed 4 different attorneys and selected one who only handles bankruptcy AND that had a very informative receptionist (why an informative receptionst? Because I know that is the person whom I will be speaking to when I call about my file most of the time) I did not sleep at all the day before my filing. I was worried about everything everbody else worries about, my circumstances and where it all fits in bankruptcy. To my suprise, it wasn't like a trip to the pricipal's office where you are there to give "your side" before it is determined whether or not you will be suspended. The filing process was a lot like purchasing a car. You provide all your expenses and then you're given a monthly payment which you will pay for 60 months.
Please do not assume that I take this process lightly, because I don't. However, while I was there, two seperate phone calls came in where the callers' home was to be auctioned the next day. Perhaps it's a strategy amongst "bankruptcy savvy" individuals or maybe these two people were like me and terrified of this whole process. If you are facing foreclosure and need to file a Chapter 13 don't wait until the last day because you think you'll win the lottery.
If you have watched your 90 days dwindle down to just a few days before the auction and you want to save your home, do yourself a favor do not wait until the day before the auction, read as much as you can on this site, talk to at least three attorneys, pick one, set up an appointment, then sit down a make a list of every single bill that you have, get a credit report if possible and write each creditor down. List the creditor, account number, amount owed and address. This will help you look at your debt in an organized manner which may help you remember debt that is not on your credit report and if you have questions for that debt you can tag it. By listing your debt, less time will be spent rummaging through paperwork with the attorney and you can spend more time asking questions, you can also prevent having to call back 20 times to add things that you may have forgotten.
