So I made my mortgage payment on the 1st. We were several months behind and have the arrears in the plan. They take my check bu thave to send it to the main office to a special department. That was 15 days ago, still hasn't cleared. Anyone know if this is going to be the norm every month? And if whenever they do finally post if they'll post it as getting it on the 1st even though it's taken them over 2 weeks to cash it?
And paid my 2nd mortgage today. It's still showing as 1 month behind (arrears in plan) so the entire payment went to interest and late charge. How long should I give them to correct everything? Should I call them??

Often during Ch 13 the big mortgage companies have a special division or another 3rd party company handle your account. It can take time to transfer the account after filing and that may be the reason for the delay. Ask your lawyer if your mortgage company is one that uses a special division or 3rd party company for their bk accounts.
One caution that you may not be aware of....be sure to send in your mortgage payment in such a way that creates independent verification that your payment was sent on time every single month. You can use your bank's online bill pay service to accomplish this or send a certified bank check every month.
The reason this is necessary is that some mortgage companies have been playing evil games with their Ch 13 filers by deliberately holding up the deposit of their on-time payments to make them appear late and then charging late fees that will appear when your case is discharged.
You have to watch that like a hawk through your entire Ch 13 since the mortgage company won't be sending you bills, only monthly statements that clearly state they aren't asking for payment (if you even get that).
I'm not saying this is going to happen to you. Just giving you the heads up that you really do need to keep track of what's happening with your payments every month. Just sending a check and noting it in your register may not be enough to prove on-time payments if your mortgage company ends up being one of those that likes to screw their Ch 13 filers and maximize their profits at their expense.

Since the mortgage companies only send a statement...how do I know if my escrow account is paying out my taxes and insurance. My statement does not show anything about my escrow account anymore except how much of the payment will go into the account....it doesn't show me an account balance. Also, the mortgage company will no longer allow me access to my account via the web...that is how I used to pay the account. What really makes me mad is that my dh did not file and he is the first name listed on the mortgage...since he is not in bk shouldn't he be allowed to see the full bill?

Thanks for the word of caution - I actually went into a branch (it's US Bank for the mortgage and local CU for our 2nd mtg) so I was given a printed receipt from the CU and the girl did a handwritten receipt for my mortgage (since the computer wouldn't accept the payment).
I guess I need to get an envelope for each so I can put receipts each month - one for the money orders for the BK, one for our mortgage, and one for our 2nd mortgage.

Our second mortgage is with Citi. I send my payment in by certified mail. They have to sign and I get back the results. They always post it as if they received the payment 5 days late when they really received it a few days early. They have tried to tell me I paid late and I have told them they sat on the money for about 5- 7 days. I do not trust these people.

I thought mine was late because even though i paid my payment on Aug 6 they posted it on Aug 12 which would have been 3 days late. Now they told me that whatever payment I send in is always treated as next month's payment so it is never late. This is only like this in a chapter 13 bankruptcy and after it's over it will be considered late. They said this is because I'm protected by the bankruptcy. I think I will for sure keep my money order receipts because I want to finance with FHA in 9 months and I want to show on time payments.

Ugh, just checked the mail and have a letter from US Bank and they are starting foreclosure - they either havne't been notified of the BK (how is THAT possible?!) or one department hasn't communicated with the other. I'll be making a call on Monday. Have to decide if I should contact the atty or just call US Bank...
