Hi, I retained an attorney finally. Unfortuantely my business is way to expensive to keep up. I am seriously thinking about closing it. It is just a small business that requires a business vehicle and the problem is I am always having to repair the vehicle now and with no credit cards, i cant afford to do it anymore. If i close it out, will they go by my income that i made in the last 6 months or even year to date? Would i have to wait so many months now to actually file? I dont know what to do at this point. Thank you!!!!

The look back period is 6 months, period. If your income is changing, you would need to wait 6 months from that change to file if you need it to relfect for your case.Filed Chapter 13 05/23/08

What kind of debt do you have? Business or personal? If you can show that your debt more than 50% business debt, you should not have to worry about the means test. There is a poster on here named southernbelle who closed a business and did a non-consumer chapter 7. Maybe you can search her posts.Filed Ch 7 -- July 9, 2008
