    Parent Plus Loans

    Hi everyone,
    I currently have Parent Plus Loans that are in school deferment. Should I start making payments on these prior to filing to bump expenses or leave them in deferment? I have passed the median income test. So no presumption of fraud.

    You need to ask that question to several experienced bk lawyers in your area. There's variation between districts, even local courts in the same district, about whether student loan payments are allowed to be included in your expenses.

    Some trustees don't allow them to count as an expense because they know the loans will be placed in deferment during the bankruptcy. Others allow student loan payments to be counted in. You need advice from bk lawyers in the know to understand what's the normal practice in your local court. This is especially important if you intend to file pro se (without a lawyer) on your own.
