    Need help: Just received something from the trustee

    Guys, I need your help to understand a document I just received in the mail from my Ch. 7 trustee.

    The title of the document is "Trustee's First Omnibus Objection to Claims."

    It shows that the claimant is Dell Financial Services (I included a DFS lease in my Ch. 7 filing). It also shows that the trustee's Proposed Treatment is to Disallow.

    Does anyone know what this means? Should I be concerned? Below is what the sheet looks like.

    Claimant Grounds for Objection Proposed Treatment
    Dell Services There is ample security for claim Disallow
    & inadequate documentation
    March 4, 2008: Filed Ch. 7
    April 11, 2008: Meeting of Creditors

    I'm not a lawyer but it sounds like your trustee doesn't believe there's sufficient grounds for Dell to file a claim in your case and is disallowing it. Of course, you should run this by a bk lawyer to make sure.

    If you are pro se, you can ask Legal Aid in your town (if you have one) for an interpretation for a very reasonable cost (they adjust their fee by what you can pay). Also some bk courts have designated help for pro se filers - is yours one of those? If you don't know, you can call your local bk court clerk and politely ask.

      Just got another letter from the trustee. I think this means that Dell has filed an objection, and the trustee's decision is to disallow my claim (which is bad for me). I have until Oct. 3rd to object.

      I'm waiting for my lawyer to respond to me about it.

      The only reason I still have the Dell equipment is that every time I call Dell to figure out how to return it, they keep sending me to different departments who have no idea what to do. It's always like this whenever I call Dell. What a bunch of BS.

        Can I ask why its taking so long for your discharge? Looks like 5 months since your meeting? Just curious and wanting to learn

          If you are talking about computer equipment, the creditor will not want it back in any case. Essentially, when you buy computer equipment off the shelf, it is 5 years out of date in terms of research and development.

          Can you scan and PM the letter to either 'Hub or me? 'Hub has more than 40 years experience in the field. We might be able to decipher it....

              My case is taking a long time because I had to surrender my tax return checks to the trustee. Basically, the trustee decided that the 90 days period for objections started once he received the tax return checks from me, which was in late May.

              I thought the case had been closed in August because I received something from the judge saying something that I interpreted to mean that the case was now closed.

              After that, I received this letter about the Dell objection.

              I will have access to a scanner tomorrow, so I can post it then. I'm going to scan the documents and e-mail them to my lawyer as well.
