Had 341 a month ago...still no word from Trustee

    Had 341 a month ago...still no word from Trustee

    We had our 341 a month ago...we filed chapter 7 but were considered to be an asset case mainly due to our car. At the 341 the trustee said that an appraiser would be calling to set an appointment with us to appraise our car and belongings. The Trustee said that phone call would happen within one or two weeks.

    Well, we still haven't heard a word from the trustee or any appraiser. Is this common? I told my husband we should call our attorney to see what's going on but he doesn't want to stir the pot. I just hate sitting and waiting. Plus he doesn't want to sign up for PACER either.

    I know the district is really backed up...and we and other people at our particular 341 session were told discharge would be closer to 90 days. So does that mean that the appraiser could call us on day 89, and this thing could go on for several months past the usual 60 days?

    I would get on Pacer.
    All answers would just be a guess, and Pacer is "from the horses mouth"!

    Maybe someone has experience with this.

      It sounds like your husband is a little bit into denial. I understand not wanting to stir the pot, but after all this time has gone by, I'd want to know what is going on too.

      Now, we were ruled and asset case, too. Our 341 was 2/7/08. Our original Last Day for Objections was 4/12/08. But when we were ruled an asset case in mid-March, our Last Day for Objections was extended to 6/12/08. Your last day might be extended too. This will show up on PACER.

        Pacer doesn't always have the answer. The answer would be to call your attorney, regardless of what your hubby wants or doesn't want to do.

          You could also call the trustee's office. They aren't big bad monsters, and their secretaries are usually pretty nice and helpful. Just tell them you were supposed to have your vehicle appraised but haven't heard from the appraiser yet and it's been a month. Perhaps the guy didn't get the message, perhaps he missed you somehow. Whatever the case is, the secretary will probably be nice enough to check up on it for you. It's her job. Ask her nicely and I'm sure she'll be happy to help.

            This would be great advice if the OP had filed pro se, but they filed with a lawyer. Unless there's a serious problem with their lawyer (and it doesn't appear that there is) their trustee won't talk to them directly. The office will recommend contacting their lawyer and have their lawyer call the trustee.

                Angelinacat, when you decided to "buy back" your non exempt property, Did you have to pay for all of the non exempt stuff or just a % of the total.
