    Sothis is how the Trustee sell stuff. Looks like if someone makes an off for the

    assets and it gets sold the debtor is SOL (and that isnt Statue of Limitations lol). Would the 5k that the debtor used as an exempt then be given back to him in cash?

    This is exactly what happens when a filer can't protect a secured asset with their state bk exemptions - in this case, a car.

    Most filers understand this is going to happen if they file - in this case, a newer car that was nearly paid off when filed. These filers consider the loss of a car and getting rid of thousands of $$ of unsecured debt better than continuing downhill swirling the financial drain until they end up with much less than losing one car.

    And yes, they do get back whatever $$ the state exempts for an automobile when the trustee sells the car.
