    Pacer: What Does This Mean?

    This was posted on our pacer acct. today. Can anyone tell me what it means. At our 341 Trustee asked our attny for copy of our 2007 tax return which attny electronicall provided and trustee continued our 341 to 9/4 then again to 9/23. This was posted today:

    Meeting of Creditors Continued on 10/21/2008 at 10:00 AM. Section 341 Meeting of Creditors held on 9/23/2008. Tape Number: 14. Notes: Amendments, current tax returns (Entered: 09/24/2008)

    We are worried because our discharge date is supposed to be 10/21/08. So does this mean our 341 is continued again for another meeting on 10/21/08 then we won't be discharged until 60 days after 10/21/08?

      No need to worry. Your discharge date is tied to the first date set for your 341 meeting, not to the multiple continuances. Depending on the reasons for the continuances, your discharge might be delayed, but it won't be delayed for 60 days after October 21 unless you are a Ch 7 asset case - are you?

      And now I'm curious...you don't have to share if you don't want to....but why is the trustee making these repeated continuances in your case?

      01/24/07 - Judge dismisses mortgage company objection
      09/27/07 - Confirmed at last!
      06/10/11 - Trustee confirms all payments made
      08/10/11 - DISCHARGED !

      10/02/11 - CASE CLOSED
      Countdown: 60 months paid, 0 months to go

        So far we are not an asset case and our attny does not seem to think that we will be as we are giving up two homes and 2 cars. We have no savings. Only a 401k.

        I'm not sure about the continuances exactly. Our attny said the first continuance happened after our initial 341 meeting b/c he had not yet sent our 2007 tax return to the trustee. So at 341 trustee cont. to 9/4. Attny provided tax returns and attended 2nd 341 meeting and trustee cont. again to 9/21 apparently b/c he did not have enough time to review our docs. Not sure why it was cont. again to 10/21. Our attny left us a message today saying everything was going well and not to worry about anything.
