    Refi? I filed 13 but wife was not included

    Our bank started foreclosure and I filed chapter 13 to stay the foreclosure. My wife was not included in the filing. I have had late payments to the mortgage company and the trustee but am current on everything now. It states in our plan that we have to either sell or refi by a certain date which is quickly approaching. I know it would be hard to refi with my name on the loan but would it be possible for my wife to refi on her own? Will my late trustee payments affect her ability to get a loan?

    Thanks in advance for any help.

    Have you discussed all this yet with your attorney? With your name on the mortgage you will need to obtain permission from the trustee to refinance. Your wife will not be able to refinance in her name only. You will probably have difficulty in this economy obtaining a refinance as even people with excellent credit are having a hard time. Give your attorney a call today and go over the entire matter. Best of luck to you!

      as long as you made you bk payments on time for the last 12 months and your fico score is 580 or higher and at least 5% equity in your home
