    Just discharged, have a few ?s

    Hello,

    I haven't posted much, but appretiate all the advice and support here.

    I looked at Pacer and my case was discharged a few days ago, but there is no link to the discharge to read it. I have a few questions:

    -how long does this usually take to update Pacer w/ the actual discharge or receive in mail? I am in VA
    ****-once it is updated can the discharge be linked to from google, or will one have to have a Pacer login to see the discharge?
    -my atty. told me a few weeks after the 341 that I was an asset case (but I never got any details and none on Pacer), I believe due to my 2nd car which is worth around $5k and I own outright. When will this be picked up?

    Not sure of your other questions but I do know that since there is a charge for pacer I dont think it would pop on google.

      Right now the courts are clogged with a larger-than-usual number of bk cases, so it could take the courts longer than usual to post your discharge to PACER.

      Since you are an asset case, the earliest you'll see your discharge post is 60 days after your 341 (it could be much longer), but your case won't be closed until your car asset has been liquidated and dispersed to your creditors appropriately.

      You can't link to your discharge on PACER. PACER requires a log on and password first to get into the document section where the discharge is kept.

      Depends on your lender. Could happen any time after they are notified about your bankruptcy. However, some of our members have waited for weeks and weeks - it's hard to know. Your lawyer may be able to give you an idea if your car lender is one he/she has dealth with before.

      09/27/07 - Confirmed at last!
      06/10/11 - Trustee confirms all payments made
      08/10/11 - DISCHARGED !

      10/02/11 - CASE CLOSED
      Countdown: 60 months paid, 0 months to go

        There isn't a lender. The poster states that they own the vehicle outright.

        Mongoos: The trustee will contact you or your attorney to tell you what is to be done with the vehicle. Wait for the trustee.

          Shouldn't the car if an asset already be sold and dispersed to creditors before seeing a discharge at the 60ish day mark?

            Thanks for the replies. Maybe I get to keep it....I just saw Pacer that the court mailed out the discharge on Friday, so I should have it Monday. There is still no link to the discharge itself. Here was the chain of events:

            7/14 filed
            8/14 Pacer updated that I completed online education (last update on Pacer until discharge)
            8/18 341, no Pacer update
            9/3 (ish) I receive letter from atty saying I am an asset case (still nothing on Pacer)
            10/30 notice of discharge on Pacer (no link and first update since 8/14).

            I will update again on Monday when I receive it.
