But, have a distressing question:
Filed: March 31,2008, Chapter 7 with assets
Extended to August 29,2008 (due to objection for an exemption under O.R.C. 23229.66(A)(10) relating to debtor pension/retirement plan (this was titled - Deferred PS Plan (401k)
Discharged: July 30, 2008
When do we start counting for the 180 day? Because we have a 1997 Toyota Tocoma p/up lawyer listed as exempt, the property record and report list vehicle net value as $1135.00. Our state of Ohio 1 exempt vehicle is $1000.00. Since then we had learned that the frame could be defective should be evaluated. When evaluated and if found frame defective they take truck on spot, we then wait for money refunded to us from Toyota (1.5 x value). Well, the bumper has just FALLEN OFF! We would like to have it evaluated, then take the money and buy a different truck (no loans!) When is it safe to do this? Will the trustee come after the money? I'm scared for my husband to drive this truck (I'm laid off right now, seasonal worker will also need vehicle in spring) Sorry to be so wordy, but need advice...lawyer just shrugged shoulders when I asked him. HELP!!!!!!
