    How to avoid creditors calling relatives/neighbors

    We have never been late but are late on everything this month. I am not letting anyone know about our bankrutcy(relatives) due to the unwanted advice I will get. Is there anyway I can make sure that they do not call any of them?

    I know if they call my mother she will ask how much we owe and pay it..she always does. But I don't want that happening due to it just being a waste as we are filing bk...

    If I'm not mistaken, creditors are not supposed to disclose the reason for the call if they were to call your mother, or anyone else. I think they are only allowed to leave a message asking them to have you call them(creditors), but I know there are some creditors that do not abide by this. I had a creditor call my supervisor and disclose alot of my information

      Whoever you listed on your credit applications as "Next closest relative that does not live with you" (name, address and phone number) is who they can contact. It doesn't take a rocket scientist to figure out if they get one of these calls what it is because how many banks/creditors call relatives looking for you when they have your address, phones and possibly email?

        Are they allowed to say what they are calling about? For instance, is a creditor allowed to call my mom and say, "your daughter is $$$ behind on payments?

          No, But they can say they are calling from example: AA Collection Recovery Company. etc. So it does not take a rocket scientist to tell what they are calling about. Once Amex started calling family that was listed in the phone book I immediately retained my attorney to put a stop to this. I had a cousin I have not spoken to in 8 years call me about a call they received.

          In short... Only way to stop these calls is to retain an attorney.

            I know, and I cannot retain one until I am 90 days within filing or I have to pay even more. I just hope they do not call family..wow I would be embarassed and stressed.

              phone stating Im over 60 days late on my cc payment blabla bla
              Now what if I had employees that could listent to that????
              Unfreakin' believable!!!! What arsholes.

                Nationwide Credit was calling all my authorized users trying to claim they had to pay if I didn't. Also dug up my brothers ex-wife's parents whom I have never even met!!
                My brother has been divorced for over 15 years! What the???

                  Say for instance you listed your mom as your closest relative on any credit application you filled out who is not living with you. Right then and there you should realize that if you don't pay your bill, they are going to contact the person you list. Sometimes they ask for two. If they cannot reach you, they will call your mom. If your mother has caller ID the number and name will appear. They will leave a message on the answering machine if she does not answer that they are so and so with so and so and are calling because they need to get in touch with you. They will provide contact information for your mother to give you to return the call. If your mother answers, they will basically say the same and as I stated in my previous posting, unless your mom has no clue what collections are all about, it's obvious what the call is all about. If your mother presses for more information, they cannot give it to her because the account is not in her name but they will ask her to have you contact them. So your mother (or other relative) is aware that you are not paying that bill.

                    it is horribly embarassing if it does happen.....the lies I have told.....oh the bank messed up.....auto-payments not through.....
                    they will try to find you through any means.

                      I would not worry too much about them calling relatives. friends, etc, if you just became late for the first time this past month. The best way to avoid having creditors and CA's call your family/friends is to answer the phone. If the caller is a collection agency do not share any of your personal financial info unless you are serious about BK. Ask them top sen dyou all the information in writing. When you receive the "dunning" letter send them a letter asking them to cease and desist communications with you and any other third parties.

                      I guess I've been pretty lucky going through my last 2+ year ordeal. My big national creditors only have numbers of friends and relatives who have sense moved on in their lives and are not easily traced. My local creditors have som elocal references I used 3 - 4 years ago, but all of these folks have also moved/ changed adresses and no longer have a home phone. However, all my friends and family know about my financial situation. It was somewhat embarrassing to disclose this with some family members and friends, but none condoned me for my situation.

                      The best you can do is probably answer the phone, tell folks you are unable to meet your current unsecured debt obligations and encourage them to "stay in contact" with you via US mail.

                      Just my thoughts.
