    multiple bk's

    i was talking to my nighbor and told him i was probably going the bk route...

    he said that he had a chapter 7, 14 years ago and really needs to file again, but hes scared they will hammer him because its his second time around...

    anybody been in his shoes?

    I've seen people post on here in the past that since they were repeat filers, they were subject to stricter scrutiny.

      At my 341 meeting, there was a couple who had filed before and they were there for a second meeting that day and the UST was there, waiting for them.
      Filed Ch 7 -- July 9, 2008
      341 mtg ---- August 14, 2008
      Discharged ---- October 17, 2008
      Closed --------- December 11, 2009!

        I don't think it matters. Just my opinion though. There are no laws being broken and 14 years is a long time.

        They usually only scrutinize repeat chapter 13 filers that abuse the system just to get the automatic stay so they can stop eviction or forclosure then get dismissals by not showing up to the 341. The 05 changes reduced but probably didn't eliminate this.

          Hubby had filed about 10 years ago and it didn't matter. The trustee asked us if we had filed bk in the past 7 years, either together or individually. His previous bk was never actually brought up.

          Unless he is trying to commit fraud or is a multiple filer in a short time, I don't think he will have any issues from the trustee or anyone else.

            I work with a lady that her and her husband has repeatedly filed Ch 13's. I don't know all the details of there situation, but I do know that once they do file, they turn around and get something new, such as car, motorcycle, etc. I think alot of their issues has to do with luxuries vs. necessities.
