    Question about reaffirmation

    My mom cosigned on an auto loan for me and she declared bankruptcy and was discharged a little over a year ago. However she did sign a reaffirmation agreement. Now I declared bankruptcy and was discharged earlier this month. I did not sign a reaffirmation agreement.

    The vehicle is a 2001 Nissan Frontier. To make it short I got the truck while single. Now I have a wife and a growing little girl and I would like to get an suv to accomodate us. The problem is the truck is so upside down that I could only expect about 2500 for a trade in and I owe about 8000 on it. Would it be possible for me to get my mom to be able to reopen her case and void the reaffirmation agreement? That way I could tell Citi Auto to just come and get it and my family buy a vehicle?

    No your mother can not reopen the case. So your mother will be responsibly for that loan. If you let the truck get repossessed your mother will have to pay any deficiencies on the loan
