    Question Can wage garnishment be stopped?

    I had a business that was sold and the franchise is claiming I owe them $8,000. They are asking for proof that these franshise payments were made. I am having trouble proving they were, I believe my employee/manager never sent the checks to them, had I known that I owed them I would have sold the business for additional the money in the sale price. Now their attourney is coming after me personally,
    I am employed by the state, can they garnish my wages? if so, can I stop it.
    If anymore is taken out of my check I won't be able to pay my bills. Thank you for your replies.

    They can claim you owe them, but they'll have to PROVE it in order to garnish your wages. Did you give the Mgr money to make these payments? If so, where did it go? In any case, here is a link for WI residence regarding garnishments.

      The payments were suppose to be paid out of my checking acct which the manager was in charge of putting the checks in the envelopes and mailing them off. She was also in charge of reconciling the checking account, I assumed she would have noticed it was not paid. I had owned this business for over ten years and never missed a payment. When I asked her about it she claims she sent the checks on the dates they were due. I don't think she took any money, I just think the payments were never sent. So there is a good chance that I really do owe it. On top of that.... my computer crashed!!! so now I have to get that mess in order. Not making any excuses except that before I sold the business why didn't they notify me that those payments were due, they waited until after I closed on the business
      Whats the most they can garnish? and for how long?

        Your bank can furnish you with copies of bank statements-for a fee o course.
        If you're filing for bk, just include that claim.

            They can't garnish until, they sue you and win.

              Keepmine has the best advice. You must have the bank and account number around, ask the bank for copies of the checks. They digitize checks these days. Do you still have the checkbook? You need to keep it for some years for IRS. If you do, look up the check numbers.

              Now better yet, get full reports or look in your archives if they haven't been destroyed. If the books balanced and the payments were not made, you have other problems. Not accusing anyone, but I worked for a business machine company and can find fraud in a minute. 'Hub

                I just went thru the checking account and I am not finding the checks they are looking for. It is very possible I still owe it. How can I stop check garnishment other than filing BK. This isn't what I expected !!
