Post 341 meeting ?

This may be a stupid question but I'm afraid to do anything without asking here first.

I've had my 341, am surrendering the house & moving to a much smaller house. Am I allowed to have a garage sale to get rid of some furniture, dishes, etc & keep the money since items were listed on my paperwork even though I am a no asset case??

Honestly I would do it, I was in the same situation. And since garage sales are cash only no one is going to know the difference. And if your no asset the courts will not be stopping by to take your furniture and sell it. Or to even make sure you still have about the amount you listed on your filing.

Thanks! There's really nothing major I want to sell anyway, just a small dresser, extra dishes, etc. so it won't add up to a lot but I don't want to just give it all to Goodwill when ANY extra cash would help me out right now.

If your case was listed as no asset already then you are probably safe. The SAFEST thing to do though is wait until you are discharged and closed. Technically, anything you own is property of your bankruptcy estate until you are closed.

Well ya Divorce is right, 100% safe would be to wait until after discharge. But if its just some random things no one is ever going to know. I wouldn't sweat it anyhow.

I'm not going to pay for storage for them so it's either sale them or give them away. Maybe I should drive them over to the bk courthouse & leave them on the front lawn!
