Anyone ever get a letter from the Trustee before 341 meeting??????

    Anyone ever get a letter from the Trustee before 341 meeting??????

    Our attorney got a letter today from the Trustee requesting we bring other documents to the 341 meeting and telling us that she is basically looking for assets. Our attorney said they had not seen this before but was sure this trustee was just being thorough. Our meeting is onthe 24th, one week from today and now I have to go gather all these things again and make more copies. Can I just take my whole stupid filing cabinet with me? Think they allow that??? LOL. O my well I guess I have no choice. We don't have assets so I am not sure if this is just some "normal" thing for this trustee or what.

      well I was going to try and paste it on here but it is in adobe format and i am too stupid to figure out how to put it on here I guess.

      Lists Debtors Duties under new law:
      ---must receive most recent years taxes in office within 7 days of 341 meeting
      ----copies of all payment advices for the 60 days prior to filing.
      --copies of most recent paystubs
      ---copy of 2007 2008 tax return with all schedules and w 2's
      ---copy of all financial accounts prepared by banks/credit unions that covers the petition filing date and 3 months prior
      ---copy of all titles of vehicles, boats, etc
      ---any judgements in my favor and be prepared to discuss them
      ----retirement account plans and recent statement
      ----be prepared to discuss any rights to an inheritance
      ---garnishment info
      --any tax refunds or other checks over $400 cannot be cashed or deposited without trustee's approval, be ready to turn those over on that day
      ---do not sell any property as it belongs to the trustee


      And then there is a debtor questionnaire as well to go with that tha thas to be filled out and brought to the meeting. Also states that everything is the trustees possession and is not ours.

      Wants to know if any property has been transferred or paid to relatives or inlaws in the last 18 months prior to filing.
      Wants to know if any money has been paid to relatives or insiders in the last 12 months.

        Okie - Most of that stuff should of been requested before you filed. My attorney requested them the month that we filed. Did you ever give any of this stuff to the attorney before?

          yes we gave all that stuff to the attorney so i dont know why they can't bring it. the only thing is why would they want most recent pay stubs? that has nothing to do with when we filed. I am sure we will be fine income wise even so but the point is i would think what we make now is not important.

            Your trustee asked for the paystubs since filing because he/she wants to verify that you both aren't bringing home a lot more money now compared to the income amount you filed with. This is one way trustees try to smoke out hidden fraud. If you aren't making a lot more money now than you both did before filing, then there's nothing to worry about.

            01/24/07 - Judge dismisses mortgage company objection
            09/27/07 - Confirmed at last!
            06/10/11 - Trustee confirms all payments made
            08/10/11 - DISCHARGED !

            10/02/11 - CASE CLOSED
            Countdown: 60 months paid, 0 months to go

              There are a couple trustees in our area that send out a letter before the 341 requesting information and they want us to provide it to them at least a week before the meeting. It depends upon the trustee, not all do this. I wouldn't worry about it though.

                In my case the TT asked for all of this and more right after the 341 meeting and then asked for more stuff right before the continued 341.

                They are just checking to verify what you have put in your petition.

                Yes, you can ask your attorney to bring the stuff if you gave it to him but I always make two copies, one for my attorney and one for me, neatly bound with tabs so that I can avoid all the last minute BS that they put you through.

                I am not worried about it and neither should you if you have nothing to hide.

                Good luck, it IS a pain though isn't it?

                  we received several letters from the trustee requesting information like that. i'd guess it's pretty normal and very common. we're WAY below median income with no assets so there were no "red flags," and he was simply verifying what was on our petition.

                  don't stress it.
                  filed ch7 pro-se on 12/22/08, 341 meeting on 1/29/09, changed from no-asset to asset case on 2/18/09, DISCHARGED on 4/3/09.

                    Thanks everyone but I am still worried. I had been feeling a little better about this whole process and then this is sent to our attorney and makes me go into depression mode again. I felt like life was starting to be a little "normal" again and now it is back to being stressed 24/7 as this 341 meeting gets closer. I will not be able to breath and live my life again until this is over.
