After a discharge and we already moved out, do we still need to tend for the yard? We just got a notice of violation concerning the grass being long. I do not know what to do as the mortgage company has not taken over it completely and we can still get inside the house and get a few of our stuff. What do we need to do? We've informed the company it is vacant but we just moved last week. Anyhow any input will be appreciated. Thanks.

Until the bank transfers the title out of your name into theirs, you are still the legal owner of the property. Also in your situation it's a good idea to keep some minimum home insurance in place until the bank transfers the title because if someone is injured on your property, as the legal owner you will still be held responsible even though you've already surrendered the home in your bk and moved out. What matters is who the legal owner is, and right now it still appears to be you.

Thanks, we spoke with the mortgage company and they sent a field inspector when we already have moved out of the house. The representative we spoke with was nice yet he did mention that since we are not occupying the property anymore, it will jsut be a matter of time till they change the keys so we wont be able to get inside and if we have valuable stuff inside the house that when they have it for auction it will be included but we can't get it anymore?? That is what is said, with that I would assume we do not need to worry about the house as we ourselves could not even get inside, is that assumption right?Filed: Jan 6, 2009
