Long story as short as possible...
I have a friend that filed a 13 with her DH 3 years ago. About a 1 1/2 years ago they couldnt afford the Trustee payment and stopped paying. She said their BK was discharged and the creditors started calling again. They contacted their attorney and he refiled it to get them a lower payment. Somehow, she said there was a clerical error and her DH is no longer listed on the BK and it is no longer on his credit. This doesnt make sense to me. She has no idea how it happened, but said she isnt going to say a word! They are now again cant afford the lower payment and wont be paying it for the next couple of months, are going to relinquish their cars and then have their attorney refile again.
Does this make sense? If there was a clerical error and it is found and they have begun getting credit in the husbands name, can they get in trouble?
