Our Chapter 7 discharge was in February. We did not reaffirm the house. We received a letter from Beneficial's local attorney saying they had been retained to foreclose. Does anyone know the timeline from here? We would like to stay as long as possible, but leave about 6 weeks to move. We are in Oklahoma. Thanks for any response!!

Here's information about how foreclosures proceed in Oklahoma - http://www.foreclosurelaw.org/Oklaho...losure_Law.htm . According to this site, normally you would have about 90 days once you receive the written intention to foreclose. The letter should be delivered as certified mail. Keep in mind that, as Luci said, the courts are quite backed up at the moment, so you may have longer than 90 days....considerably longer.
If you had a good relationship with your Ch 7 lawyer, you might give the office a call and ask how long foreclosures by your lender have been taking lately in your area.I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

07/18/06 - Confirmation Hearing - not confirmed, 3 objections

08/10/11 - DISCHARGED !

This was a regular letter, not certified. I did call my chapter 7 attorney and he said we had between 3 and 6 months. I can't decide if the 'waiting to move' stress outweighs the 'saving rent money' benefit!
This forum helps with the 'stress' factor. Just sharing with everyone who is in the same boat helps a lot!!
