See no other alternative but hope make right choice:

I am a single women w/2 grown children. I have about 30,000 in credit card debt.. I have had a pretty decent income the past couple yrs. My debt was incured after a divorce and raising my kids. Last yr my son graduated and I lost the child support that use to pay the credit cards. Since then its been a downward spiral. Yes, I feel like it was my fault because I didnt plan well in advance and yes I am a compulsive buyer at times.. (have worked hard on that and much better now). Anyway, I am concerned about not having any money left over each month , but then again, wait, its been like that for the past yr anyway.
Friday morning Chase collection lawyer called. I owe them 12,000. There offer was this:
No More Interest. I can pay $1000 a mth for 10 mths and they will forgive the rest of I can come up with $8000 cash this weekend and pay them next week and they will forget the rest .... HELLO, if I had $8000 laying around I wouldnt be in this mess..
My boyfriend is TOTALLY against me filing bankruptcy..He says I will be blacklisted for the rest of my life... He thinks there has to be another way out. I tried the Debt Settelment Company route and got sued which is why I have to decide soon what to do..
I am wondering w/roughly $30,000 unsecured debt what is the most my pmts could be on a 100% payback plan... My 20 yr old son lives with me and has a minimum wage job. He got cut back to 32 hr a wk.. The attorney I spoke w/said its considered a 2 person household but only a 1 person household on the means test ..confused me there ?? Anyway, I have another appt w/him next Thursday...I am thinking this is going to be the way I have to go... I see no other alternative at this time... I want to keep my house and my car. Both have a very reasonable pmt on them but I am hoping he can give me some numbers next week so I know what I am looking at.
Seems like the more I read on here the more confused I get about somethings but yet I find it helpful too..

There was no more confused people as well as totally uninformed than my wife and I. We had no choice and we had big bucks at one time. We never thought that we would ever get caught into the business decision we had to make. That is plain and simple, it is a business decision that is all. About your credit rating, what got you into this? Credit. Stop using the cards at once, try purchasing with cash and if you don't have the cash you don't need the item. You need only basic necessities in life and that is a fact. Food clothing shelter.

If you keep reading here, you will soon understand that you are only one of many. However, you are luckier than most as you have come to the conclusion that you have to get relief. Many more will come after you have, with this economy going the way it is.

Do not hold your tongue with your lawyer. Ask him to clarify stuff. They are noted for assuming you understand every word they speak or in most cases, don't speak. Read all the "stickies" on the C7 and I would stay away from C13 with the income you imply. Get a fresh start, don't drag out then most likely fail in a 13. Stay away from those get out of debt companies. They are all over the radio now. I wonder why? They will fleece you and cost you much more.

You say your boyfriend believes you will be blackballed forever? Who needs credit. We paid our car off in bk, and we get credit card offers all the time. I don't own a credit card and if the Debit card fails to work, the money is gone. I use no checks so no NSF. What do you need credit for? Pay through on your house and car. They won't take it from you if you keep paying. Boyfriend may become husband and his credit is there anyway. My opinion is to keep reading on about others and you will come to the right decision for yourself. 'Hub
If I knew it all, would I be here?? Hang in there = Retained attorney 8-06, Filed 12-28-07, Discharge 8-13-08, Finally CLOSED 11-3-09, 3-31-10 AP Dismissed, Informed by incompetent lawyer of CLOSED status, October 14, 2010.

First and foremost, make a list of your questions and take it to your attorney and "get answers." The attorney is there to represent you and should tell you upfront as to your questions; if they hem and haw, seek other counsel.

Secondly, work hard starting now on changing your lifestyle or you will find yourself in the exact same position you are in several years down the road. Stores and online shopping are set up for impulse purchases. "Buy this now while on sale (in 50 different colors) and be the envy of everyone at work!" LOL! You know what I mean. No one really cares...and all you have is a stack of bills from it. Getting out of being materialistic is difficult but is needed to reinvent yourself and get out of financial difficulty. The BK will clense the slate but you have to continue to keep it clean afterwards by being in control of your money and not letting it control you. We too leaerned the hard way but as the years have passed, we know that if a job loss or any other life event occurs, we would not even have to consider filing.

Best of luck to you and chin up - it's all worth it in the end. And don't be afraid to ask that attorney any questions...
