I had my 341 today. I watched several cases that were in an open courtroom. Needless to say, I was a nervous wreck. After watching several, I thought I can handle this. He was very easy on them but this ended up not being my trustee. I was called into a seperate room which I liked because no one could be in there with me. He swore me in and asked me questions, the general ones, and then he asked what I did for a living, how long I had been doing that, and what kind of car I drove (which is not mine). I answered as honest and truthfully as possible. He told me good luck at the end. I was scared to death that he would try to convert me into a Chapter 13. If this was going to happen would they have brought it up then. It is a no asset case. Thanks for your response in advance.

Now a 60 day wait for discharge!!!

No, not a chance. The chapter 7 trustee doesn't benefit in anyway if you are in a chapter 13. They simply look to take any non-exempt assets you may have and distribute it among creditors and keep a percentage. It's the US Trustee that would try to get your case converted to a 13 or dismissed. If your expenses are based on the IRS standards then in 2 more months you will be FREE! If you have high expenses then the UST would file a motion to convert or dismiss. Good luck.

Well, my attorney told me to contact him this week to see what the trustee had reported. I bit the bullet and called today. Yeah, no asset case for me. I asked them if the US trustee reviewed all cases or randomly selected people. They told me that with the cases they have had the US trustee usually contacted them before the 341 meeting. Sounded great but I'm not counting on it either. I'm about 2,000 over the median income for my state so a little nervous about that. Wish me luck!!1
