    US Trustee program interesting reading

    Here's a link to the DOJ annual report site and under the civil or criminal sections you will see exactly what the US Trustee is looking for. What a bunch of thugs! (talking about the frauds, not the DOJ). I actually have much more respect for the US Trustee program after reading some of this.

    My favorite one in the fy 03 manual was the lady that opened a bunch of credit cards under her 3 dogs name, charged up a storm and tried to get a discharge. She should have just been honest and brought the dogs to the 341so they can raise their paws to be sworn in. LOL

      Wow did you see that one where the guy prepaid for a 24 month lease with a credit card 4 months before filing bankrupcty?!?

      Smart and not smart all at the same time I guess you could say... I bet there are people that get that through the system, unfortunately for him he was caught.

      I was worried about my amounts and things, these people were trying to fraud A LOT of money... most of them are over 200k!!!!

      Great reading, I only read the 2004 one, but will probably have to read the rest too.

            Yeah, found the dog one and man oh man, what a bunch of cheats!!

            Now that I see what some people have pulled (Or tried to) I think the new laws had a good reason, but still are too screwy...

              Okay, thanks. Now I see it. I noticed that the Trustee didn't list many examples of going after creditors for violating the law. They mainly come after BK filers. I think I can see who's side they're on.

              I noticed they came after one guy who ran up a large credit card debt, but he only had a small or modest income when he ran up the debt. That's what would probably happen to me if I filed right now. I ran up about $30,000 in credit card debt, and I filed a tax return stating that I was unemployed and my income was $0 for various reasons that I probably shouldn't go into right here. Anyways, I'm hoping that if I wait long enough, like for 5 or so years, maybe they won't care so much what my income was at the time I incurred the credit card debt. This is how my logic works on this issue...

              I've heard that they only need to see 1040 tax returns for the two years before filing BK, so if I wait long enough, they won't ask to see what my tax return said I made in the year 2004 and 2005, when I ran up my credit card debts. They'll only be asking me for 2006 and 2007, right?

              Also, since I don't have any assets except for a 2006 Chevy truck with $16,000 owed on it, they won't be able to do anything to me for the next few years, even if they get a judgment. And I work as an electrician and get paid by cash or check from each job, so there is nothing to garnish. So, I figure if I can go long enough, the credit cards will get tired of it, and not object when I finally do file for bankruptcy-- maybe 5 or so years from now. Because maybe they will get to the point where they haven't received any payments from me for such a long time, and they can't find any assets to take from me, and can't find any employment to garnish, that perhaps they will want to just let this debt go and write it off of their taxes, right?

              I plan on trading in my truck for a new truck every 3 or 4 years, so there will always be a lot owed on it, and hopefully, creditors won't be interested in trying to take it from me, because they would have to pay off the balance of what is owed on it before they could repossess it, right?

              Well, that's my plan anyways, and I will let you all know how well or how poorly it works out. That is of course, if any of you are still reading this forum 5 years from now. I kind of doubt that. This forum may not even exist at that point.
